§1 Definitions

  1. Personal Data – Any information relating to an identified or identifiable natural person. Information is not considered identifiable if determining the identity would require disproportionate time, cost, or effort.
  2. Delivery – Type of shipping service including carrier and cost.
  3. Proof of Purchase – Invoice, receipt, or sales slip issued in accordance with the VAT Act of 11 March 2004 (as amended) and other applicable legal provisions.
  4. Client – An adult natural person with full legal capacity, a legal entity, or an organizational unit without legal personality but with the capacity to perform legal acts, placing an order in the Golden Rules online store.
  5. Civil Code – The Civil Code Act of 23 April 1964 (as amended).
  6. Consumer – An adult natural person with full legal capacity who places an order not directly related to their business or professional activity.
  7. Cart – A list of selected products based on the Buyer's choices, created from items offered in the online store.
  8. Buyer – Both Consumer and Client.
  9. Place of Delivery – Postal address provided by the Buyer.
  10. Payment – Method of settling the amount due for the order and delivery.
  11. Privacy Policy – Rules regarding the processing of Buyers' personal data by the Data Controller, the rights of Buyers, and the obligations of the Controller, available at: goldenrules.com.pl/polityka-prywatnosci
  12. Consumer Rights Act – The Act of 30 May 2014 on Consumer Rights.
  13. Product – The minimum indivisible unit of goods that can be ordered, listed as a price/unit item in the Seller’s online store.
  14. Subject of the Contract – The products and delivery included in the sales contract.
  15. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation).
  16. Store – The online service available at goldenrules.com.pl through which the Buyer can place orders.
  17. Order Fulfillment Time – The number of business hours or days specified on the product page.
  18. Business Days – Monday to Friday, excluding public holidays.
  19. Agreement – A contract concluded remotely or off-premises in the case of Consumers (under the Consumer Rights Act), or a sales contract in the case of Buyers (under Article 535 of the Civil Code).
  20. Order – A Buyer’s declaration of intent submitted via the store, clearly specifying: product type and quantity; type of delivery; payment method; delivery address; and Buyer’s details – all directed toward concluding a contract between the Buyer and Seller.


§2 General Terms

  1. These Terms and Conditions define the rules for using the online store available at www.goldenrules.com.pl.
  2. Placing an Order in the Online Store requires the Client to read and accept these Terms and Conditions at the time of placing the Order.
  3. The Seller undertakes to provide services and deliver goods free from defects.
  4. All prices displayed by the Seller are in Polish currency and include VAT. Product prices do not include delivery costs.
  5. Each product available in the store is described on its product page. Please note that due to the nature and uniqueness of jewelry, individual items may differ slightly from one another or from the images shown on the website. Monitor settings may also affect the perceived color and appearance of products.
  6. The Seller ensures proper operation of the store for users accessing it via the following browsers: IE version 7 or newer, Firefox version 3 or newer, Opera version 9 or newer, Chrome version 10 or newer, Safari – all with the latest versions of JAVA and FLASH installed, and with screen resolution above 1024 px. Use of third-party software that may affect the browser's performance (e.g., plugins) may impact proper store functionality. For full functionality, we recommend disabling such software.


§3 Contract Conclusion and Fulfillment

  1. Orders can be placed 24/7.
  2. To place an order, the Buyer must perform at least the following steps (some may be repeated multiple times):
    - Add product(s) to the cart
    - Select delivery method
    - Select payment method
    - Specify delivery address
    - Submit the order using the "Buy and pay" button
  3. For Consumers, the contract is concluded at the moment the order is placed.
  4. For Clients, the contract is concluded upon acceptance of the order by the Seller, which will be confirmed within 48 hours of order placement.
  5. Order Fulfillment Time refers to the time needed to prepare the order and hand it over to the delivery service.
  6. Order fulfillment begins once the Online Store receives payment confirmation from the payment service provider.
  7. Clients receive a receipt with the delivery. Upon request, a VAT invoice may be issued for business customers.


§4 Payments

1. Online payments are processed by Autopay S.A.

2. Accepted payment methods include:

a. Shoplo-supported cards: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro

b. PayPal (as per the terms and processing times listed at www.paypal.com)

c. Przelewy24 (as per the terms and processing times listed at www.przelewy24.pl). Payments via Przelewy24 should be made within 3 business days from order confirmation. After this period, the Seller reserves the right to cancel the order.


§5 Shipping Costs and Delivery Times

  1. Delivery time includes the order preparation time by the Seller and the shipping time by the carrier. Preparation time typically takes up to 3 business days from contract conclusion.
  2. Total order fulfillment time is approximately 5 to 7 business days within Europe. For destinations outside Europe, delivery times may vary and will be communicated individually.
  3. For card payments, fulfillment begins upon receipt of payment in the Seller's account.
  4. Delivery time may vary depending on the selected shipping method.
  5. The parcel will be delivered to the address provided in the order form.
  6. Domestic shipping options:
    - Courier: PLN 20
    - InPost parcel locker: PLN 15
  7. International shipping options:
    - International Post: PLN 30
    - InPost International: PLN 40
    - Courier:
     – Europe: PLN 60
     – Outside Europe: PLN 200
  8. Free domestic shipping is available for orders over PLN 500.


§6 Right of Withdrawal

  1. In accordance with Article 27 of the Consumer Rights Act, a Consumer has the right to withdraw from a distance contract without providing any reason and without incurring any costs, except those specified in Articles 33 and 34 of the Consumer Rights Act.
  2. The withdrawal period is 14 calendar days from the date the Consumer receives the goods. To meet the deadline, it is sufficient to send a withdrawal declaration before the period expires.
  3. The declaration may be submitted using the withdrawal form (Annex 1 to these Terms and Conditions) or in any other form compliant with the Consumer Rights Act.
  4. The Seller will promptly confirm receipt of the withdrawal declaration by email.
  5. If the Consumer withdraws from the contract, it is considered void.
  6. The Consumer must return the goods to the Seller without delay, and no later than 14 days from the date of withdrawal. The deadline is met if the Consumer sends the goods before the 14-day period expires.
  7. The Consumer bears the direct cost of returning the goods.
  8. The Consumer is not liable for the cost of delivering digital content not stored on a tangible medium, provided they did not give explicit consent to supply it before the withdrawal period ended or were not informed about the consequences of such consent.
  9. The Consumer is liable for any diminished value of the goods resulting from use beyond what is necessary to establish their nature, characteristics, and functioning.
  10. The Seller will refund all payments received from the Consumer without undue delay, and no later than 14 calendar days from the date of receiving the withdrawal declaration.
  11. The Seller will issue the refund using the same payment method used by the Consumer, unless otherwise agreed.
  12. The Seller may withhold the refund until the goods have been received or until proof of return has been provided, whichever occurs first.
  13. The right of withdrawal does not apply to contracts:
    - where the price depends on fluctuations in the financial market beyond the Seller’s control;
    - for non-prefabricated goods made to the Consumer’s specification or clearly personalized;
    - for perishable goods or goods with a short shelf life;
    - for sealed goods not suitable for return due to health protection or hygiene reasons if unsealed after delivery;
    - for goods which after delivery become inseparably mixed with other items;
    - for sealed audio or video recordings or computer software unsealed after delivery;
    - for digital content not on a tangible medium, where performance has begun with the Consumer’s prior consent before the withdrawal period expired;
    - for newspapers, periodicals, or magazines, except for subscription agreements.


§7 Warranty for Defects (Liability)

  1. For Clients (non-Consumers), the Seller limits liability for physical and legal defects to 2 years from the date of delivery.
  2. For Consumers, the Seller is liable under Articles 556 et seq. of the Civil Code for any non-conformity of goods.
  3. If the item has a defect, the Consumer may:
    - request a replacement with a defect-free item;
    - request the defect be remedied;
    - submit a declaration of price reduction or withdrawal from the contract (unless the defect is minor).
  4. The Seller may refuse the Buyer’s chosen remedy if it is impossible or would incur disproportionate costs.
  5. Consumers exercising warranty rights must return the defective goods to:

  6. Shipping costs for justified warranty claims are covered by the Seller, except where outlined in §7 pt. 10.
  7. The Seller is obliged to respond to the Consumer’s warranty request (e.g., price reduction, replacement, repair) within 14 days, or 30 days for other statements under consumer law. Failure to respond means the Seller has accepted the Consumer’s request.
  8. The Seller is liable for defects discovered within 2 years of delivery (or 1 year for used goods). Claims for replacement or repair expire 1 year from the date of defect discovery, but not earlier than 2 years after delivery.
  9. If the product has an expiry date longer than 2 years, the Seller remains liable for defects until that date.
  10. In cases where the Seller has acted fraudulently or concealed the defect, time limits do not apply.
  11. The Consumer may also seek compensation for losses related to entering into a contract unaware of the defect.


§8 Privacy and Data Protection

  1. The Data Controller is Golden Rules Olivia Zmysłowski (VAT ID: 6751719284, REGON: 523598751).
  2. The Controller processes Buyers’ personal data in accordance with the law, based on consent or legitimate business interest.
  3. Personal data is collected only when justified by contractual or legal obligations.
  4. Providing consent is voluntary and may be withdrawn at any time.
  5. Data collected for order processing includes:
    - postal address (for receipts);
    - delivery address;
    - email (for communication);
    - phone number (for some delivery options).

§9 Final Provisions

  1. No part of these Terms and Conditions intends to infringe Buyer rights. In the event of a conflict with applicable law, such provisions shall be interpreted in favor of the Consumer.
  2. Registered Buyers will be notified of changes to the Terms via email at least 30 days before the new version takes effect.
  3. The version of the Terms accepted at the time of order placement shall apply unless the Consumer explicitly opts for the updated version.
  4. Any matters not regulated herein shall be governed by applicable Polish law.
  5. Disputes may be resolved through mediation with Provincial Trade Inspection Authorities or other recognized ADR entities, including the EU ODR platform. The Seller agrees to out-of-court consumer dispute resolution.
  6. Otherwise, disputes shall be resolved by the court with jurisdiction over the Seller’s place of business.
